NOTICE OF AGENCY RULEMAKING ADOPTION

 

AGENCY: Department of Health and Human Services, Office of Aging and Disability Services

CHAPTER NUMBER AND TITLE: 10-149 C.M.R. ch. 5, § 16, Adult Protective Services: Administration

ADOPTED RULE NUMBER: 2021-041 (Repeal)

CONCISE SUMMARY:

 

This rule repeal removes outdated information regarding Adult Protective Services (APS) case records management practices, including retention, transfer, maintenance, and case review. Now that APS files are maintained electronically, this rule fails to reflect the practices of OADS. This rule was part of the Office of Elder Services Policy Manual. The Office of Elder Services and the Office of Adults with Cognitive and Physical Disabilities Services merged in 2012, establishing the Office of Aging and Disability Services. As a unit within the Office of Aging and Disability Services, APS follows the record retention policies established by the Department of Health and Human Services as well as the Maine Secretary of State.
