Postponement of approval expiry dates for renewals of 8 active substances

HSE has agreed a postponement of the approval expiry dates for eight active substances which were due to lapse within the next six months.

Under the GB Biocidal Products Regulation, where for reasons beyond the control of the applicant, the approval of the active substance is likely to expire before a decision has been taken on its renewal, the Secretary of State with the consent of Ministers in Scotland and Wales can issue a decision postponing the expiry date of approval for a period sufficient to enable the competent authority to examine the application.

 

Under these arrangements, the approval expiry dates for the following active substances have been postponed until 24 July 2023:

  • Propiconazole
  • Metofluthrin
  • Sulfuryl fluoride
  • Alphachloralose
  • Sulfuryl fluoride
  • Aluminium phosphide releasing phosphine
  • Boric acid
  • Disodium tetraborate pentahydrate

The GB List of Active Substances will be updated to reflect this decision and there are no further changes in the approvals.


Open invitations - Active substance/product type combinations eligible for notification under the GB biocides active substance Review Programme

Prior to 1 January 2021, open invitations were published for several active substance/product type combinations under the EU biocidal active substance Review Programme.

Those open invitations allowed a person, company or task force/consortium to take over the role of participant in supporting the specified active substance/product type combination in the EU Review Programme because either:

  • the person, company or task force/consortium supporting the active substance (the participant) decided to withdraw their support;

  • the active substance was redefined (where it became clear that the identity of the substance being evaluated did not entirely match the substance that was initially supported, and therefore it may not be appropriate to apply the conclusions of such an evaluation to the substance as it was initially identified); or

  • a person, company or task force/consortium made a compliant declaration of interest (to add the active substance/product type combination to the Review Programme)

On 1 January 2021 HSE published open invitations for those same active substance/product type combinations to provide an opportunity for a person, company or task force/consortium to take over the role of participant in the GB biocidal active substance Review Programme.

 

If no-one takes over the role of participant, these active substance/product type combinations will be subject to a GB non-approval decision. Biocidal products containing them for the affected product types will have to be removed from the market in Great Britain.

 

What you need to do

If you wish to support one of the active substance/product type combinations, you need to submit a notification to HSE by the deadline indicated in the open invitation.

 

If your notification is compliant HSE will inform you of the deadline for submitting your full active substance dossier (normally 2 years from declaring your notification compliant).

 

Please note that GB notification and dossier submissions are separate to any EU notification/submission to the European Chemicals Agency (ECHA), via R4BP.
