Updated Plant Protection Product (PPP) guidance has been published detailing how the UK Internal Market Bill and Northern Ireland regime may impact you and your business. The updated guidance also outlines how Following Zonal and Mutual Recognition applications in Great Britain (GB) will be impacted at the end of the Transitional Period. After the end of the Transition Period, no further Mutual Recognition or Following Zonal applications can be accepted under the GB regime. Mutual recognitions can continue to be considered in Northern Ireland (NI). If you are a pesticide manufacturer/authorisation holder: Current authorisations and approvals remain in place, but you should consider where you wish to make future pesticide applications. From 1 January 2021, you will need to make new applications under the GB and EU regimes to gain access to GB and NI/EU markets. Future applications for renewal of current authorisations and approvals also need to be made under the GB and EU regimes. If your business trades in food produce: From 1 January 2021, Maximum Residue Levels (MRL) in GB and the EU may start to diverge over time, so you should ensure that you and your suppliers understand the requirements in your target market. If you are a pesticide user or agronomist: The same products will be available as now. You should continue to use only authorised products and follow the instructions on the label. This will ensure the food that you produce meets the MRL requirements in the domestic market. If your produce is intended for export then you and your buyers should ensure you understand the MRL requirements in your target markets as these could diverge from the GB rules. The UK Transition period will end on 1 January 2021. From 1 January 2021, in Great Britain (England, Scotland and Wales) a new independent pesticides regulatory regime will operate. After the transition period, retained EU law – such as Regulation 1107/2009 on plant protection products and Regulation 396/2005 on maximum residue levels - will apply in Great Britain (GB). This will be published on legislation.gov.uk with links to the changes made by EU Exit Statutory Instruments so that the legislation can work in a national context. The Pesticides (Amendment) (EU Exit) Regulations 2020 ensures that the retained law can operate in GB after the end of the transition period. This Statutory Instrument (SI) is currently draft legislation and is due to come into force by 1 January 2021. The SI makes minor technical updates to address recent EU regulations which have come into force since earlier EU Exit SIs. It also amends earlier EU Exit SIs to remove references to Northern Ireland (NI), because in line with the Withdrawal Agreement and Northern Ireland Protocol, the EU regulations will continue to apply.
