Preparation of a restriction dossier on substances in tattoo inks and permanent make-up (PMU): call for evidence

HSE is preparing a restriction dossier that will assess the risks of substances in tattoo inks and PMU.

 

HSE will propose restrictions if these are needed to manage any significant risks identified.

 

To help compile the dossier, HSE has opened a call for evidence. Interested parties can respond with general information and information on specific topics.

 

Those who submit comments will be asked if they are willing to be contacted to discuss information that they have submitted.

 

The finalised dossier, including any restriction proposal, will be published on HSE's website, expected to be in April 2022. Interested parties will then be able to submit comments on any proposed restriction.

Reminder that Downstream User Import Notifications (DUINs) are required by 27 October 2021

The DUIN process enables existing supply chains to continue and allows businesses time to determine how best to comply with the registration obligations under UK REACH. However, they will need to make sure that the chemical is eventually registered for UK REACH purposes.

 

You will be able to make use of this notification provision if you:

  • Have acquired importer obligations under UK REACH as a previous downstream user or distributor of a substance covered by an EU-based registration, or

  • you were previously covered by an Only Representative in the EU/EEA you are able to make use of this notification provision to ensure continuity of supply.

Downstream users can notify the HSE of their intention to continue importing substances from the EU or EEA by 27 October 2021 using a Downstream User Import Notification (DUIN).


UK REACH authorisation decisions

The Secretary of State for the Department for Environment, Food and Rural Affairs (Defra), with the consent of Scottish and Welsh Ministers, has made a decision on a transitional application for authorisation submitted by PPG Industries (UK) Ltd., Boeing Distribution (UK) Inc. and Wesco Aircraft EMEA, LTD (UK), for the time-limited use of a substance of very high concern (SVHC) under UK REACH.

 

The Defra Secretary of State has granted authorisation to PPG Industries (UK) Ltd., Boeing Distribution (UK) Inc., and Wesco Aircraft EMEA, LTD (UK) for the following uses of 4-(1,1,3,3-tetramethylbutyl)phenol, ethoxylated (4-tert-OPnEO):

  • The formulation of a hardener component containing 4-tert-OPnEO in aerospace and defence two-part polysulphide sealants (use 1)

  • Mixing, by aerospace and defence companies, and their associated supply chains, including the Applicants, of base polysulfide sealant components with 4-tert-OPnEO-containing hardener, resulting in mixtures containing <0.1% w/w of 4-tert-OPnEO for aerospace and defence uses that are exempt from authorisation under Art. 56(6)(a) of EUR 2006/1907 (use 2)

This authorisation decision was made under Article 127G which relates to a transitional measure of UK REACH.
