Addressing China's Registration Requirements for Facilities Exporting Certain FDA-regulated Foods to China

The U.S. government is engaging China to determine the impact of two new Chinese measures (Decree 248 and Decree 249) on U.S. firms exporting foods to China. FDA is working closely with U.S. trade agencies, including the Office of the U.S. Trade Representative (USTR) and USDA/Foreign Agricultural Service (FAS) and understands the significant uncertainty for U.S. exporters and the need for prompt and clear communication. GACC Issues Explanatory Letter on Decree 248

The U.S. government is actively seeking further details on implementation of Decree 248 from China's General Administration of Customs (GACC).  In the September 29 letter, GACC appeared to confirm that current registration of U.S. firms for seafood, dairy, and infant formula products will continue to be valid. We have specifically requested confirmation of the applicability of our existing agreements with China for these and other products to ensure that trade continues uninterrupted past the deadlines referenced in GACC's explanatory letter of September 29.  Once we receive GACC's confirmation on the coverage of existing agreements, we will be able to provide further details to help U.S. firms comply with any new establishment registration requirements for China.

Exporters of the 14 commodities listed in Paragraph 1(3) of GACC's letter should pay particular attention to new registration requirements and be alert for future announcements from FDA: casings, bee products, egg and egg products, edible fats and oils, stuffed wheaten products, edible grains, milled grain industry products and malt, fresh and dehydrated vegetables, beans, seasonings, nuts and seeds, fruits, unroasted coffee beans and cocoa beans, special dietary foods, health foods.  

In the meantime, GACC has indicated that their portal for exporting companies to self-register their facilities and products will open on or around November 1, 2021 at www.singlewindow.cn. U.S. firms that produce and export foods that are not listed under Article 7 of Decree 248 should consider self-registration after that date.  Firms may provide their FDA Establishment Identifier (FEI) as the identification or approval number for registration with China. Firms may look up their FEI numbers by name and address using the FEI Search Portal.

As we receive additional information regarding implementation of China's registration requirements, we will provide it.
